If you do not agree to these Terms and Conditions, you may not use any part of the Service.

Subject to these Terms and Conditions, we offer the Service for your own use, and not for the use or benefit of any third party.
We will do our utmost to ensure that the Service is available and not interrupted. However we cannot guarantee that the Service will always be available or error-free. Please note that the Service may be unavailable due to maintenance, technical issues or matters beyond our control.
We may withdraw, suspend or amend the Service (or any part of it) without notice at any time or withdraw the Service (or any part of it) indefinitely. We may also restrict access to some or all of Service at any time for any reason. If you are in breach of these Terms and Conditions, or we reasonably believe you to be in breach, we may take any of the actions set out in Breach of these Terms and Conditions below.
Registration
You will need to register with us in order to use the Service. We may from time to time provide limited content and features to unregistered users on our Website. You may also need to register to take advantage of any competitions, promotions, offers or any features we may offer from time to time.
You must provide certain details in order to register, such as a username, password and email address. In order to complete your registration you will need to activate the link we send to you by email. Please also note that, in accordance with our TiCL Rules and User Guidelines you must ensure that Your Content does not infringe any copyright, database right, right or privacy or publicity or trade mark of any other person. By submitting Your Content to the Service, you are warranting that you have the right to grant us the non-exclusive licence described above. If you are not in a position to grant such any such licence you must not submit Your Content to the Service.
Your Content will be considered non-confidential.
We will not be responsible, or liable to any third party, for the content or accuracy of Your Content.
We have the right to remove Your Content (or any of it) if, in our opinion, such material does not comply with the TiCL Rules, User Guidelines or any other provisions of these Terms and Conditions. Please note that we do not monitor the Service but the Service includes functionality allowing users to report Content which they believe to be in breach of the TiCL Rules, User Guidelines or any other provisions of these Terms and Conditions. We will take such action as we deem fit on receiving any such report. We have the right to disclose your identity to any third party who is claiming that Your Content constitutes a violation of their intellectual property rights, or of their right to privacy.
We also have the right to move your Content to other parts of our Service if we believe it more appropriate for that Content to be posted in another part of our Service. For example, if you post Content concerning a particular business on a page dedicated to a certain geographical area and the business is not situated in that area, we may move your Content to a page dedicated to the geographical area where the business is situated, or we may remove it if there is no page for that geographical area.
Intellectual property rights

Apps
The Service may include (without limitation) the provision by us of software applications (“Apps”) for download from our Website or from third party application stores authorised by us such as Google Apps Marketplace or the Apple App Store (“Third Party Stores”). Please note that any use of Third Party Stores to download any Apps will be subject to the terms and conditions of use of such Third Party Stores.
You may use any App for the purposes only of accessing and using the Service on your mobile or other device. You may not separate any individual component of the App for use on another device or computer, or transfer it for use on another device or computer or use it, or any portion of it, over a network, and may not sell, rent, lease, lend, distribute, or sublicense or otherwise assign any rights to the App in whole or in part.
We may from time to time make available updates or upgrades to the App. Upgrades and updates will not be automatic unless you expressly agree.
You may not:
a) modify, reverse engineer, or disassemble the App or any software incorporated within it whether in whole or in part;
b) save as permitted by law, decompile the App in whole or in part; or
c) create any derivative works from or of the App; or
d) bypass, modify, defeat, or tamper with or circumvent any of the functions or protections of the App or any mechanisms operatively linked to the App.
TiCL Rules
You must at all times use the Website and the Services in a responsible and legal manner. You must comply with the spirit of the following standards as well as the letter. We will decide in our ultimate discretion whether you have breached these TiCL Rules.
You must not use the Website or the Services:
- to collect or contribute money for any purpose;
- for the purposes of gaming, gambling, betting or lotteries;
- to sell or otherwise transfer TiCL Items
- in any way that breaches any applicable local, national or international law or regulation;
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- for the purpose of harming or attempting to harm minors in any way;
- to conduct, display or forward raffles, surveys, lotteries, contests, pyramid schemes or chain letters
- to send, knowingly receive, upload, download, use or re-use any material which does not comply with our standards relating to Your Content, set out below;
- to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
- to introduce viruses, trojans, worms, logic bombs, keystroke loggers, spyware, or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website or Services, the server on which the Website or Services are stored or any server, computer or database connected to the Website or Services. You must not attack the Website or Services via a denial-of-service attack or a distributed denial-of service attack;

- give the impression that it emanates from us, if this is not the case;
- advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse;
- contain any advertising or promote any services in any manner which would breach any applicable advertising, marketing or consumer law or regulation;
- give the impression that it has been posted by a consumer when it has been posted by an individual on behalf of, and for the purposes of promoting or advertising, a business;
- contain any statement which you know or believe, or have reasonable grounds for believing, that members of the public to who, the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism or other criminal activity;
- breach any of the User Guidelines
If in breaching any of these provisions, you commit or we have reasonable cause to believe you have committed, a criminal offence, in addition to our other rights set out in these Terms and Conditions, we may report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.
TiCL Items
From time to time as part of the Service we may award you, or offer you the opportunity to purchase or earn, TiCL Tokens or other virtual items (“TiCL Items”). TiCL Items may be used by you to access and use certain enhanced features of the Service as we may specify from time to time. TiCL Items can only be issued or sold by us.
TiCL Items are neither property nor currency. They are not redeemable and have no monetary or other value. If you buy or otherwise receive a TiCL Item, you do not own that TiCL Item and you have no property interest in that TiCL Item. By purchasing or otherwise receiving any TiCL Item from us, we are granting you a personal, non-transferable, revocable licence to use the TiCL Item within the Service only for the purposes we specify and for no other reason. Any TiCL Item balance shown in your Account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your licence granted under these Terms and Conditions.
TiCL Items are not Your Content. All intellectual property rights in TiCL Items, including rights in the name of the TiCL Item, logo, design and icon, belong to us and shall remain vested in us.
You must not sell or transfer TiCL Items to anyone, whether within the Service or outside. TiCL Items may only be used for the registration and account for which they have been awarded or purchased. Please note that if you have more than one account, you cannot transfer them between your accounts.
Purchases of TiCL Items are final and non-refundable. We may change the purchase price for TiCL Items at any time.
TiCL Items may be withdrawn, suspended or terminated at any time for any reason. We may change the way in which you can use TiCL Items and may cease issuing or accepting TiCL Items at any time. TiCL Items may be issued with an expiry date. Please note, in particular, that you may lose the right to use TiCL Items if we cease to provide the Service or any part of the Service which is relevant to the TiCL Item, if we delete or suspend your Content, if you stop using the Service for a period of time in excess of 12 months, if we terminate or suspend your right to use the Service or if you are in breach of these Terms and Conditions. We have no liability to you arising out of your use or your inability to use any TiCL Items, whether or not such TiCL Items have been purchased by you from us.
Payment
TiCL Items are currently only available to purchase via the App. All purchases are made through the Apple In-app purchasing system or the Android In-app billing system (as the case may be) depending on your mobile device. Payment made by these methods is subject to the terms and conditions imposed by Apple Inc, and Google respectively. Please read them carefully before purchasing any TiCL Items.
The price of the TiCL Items will be as quoted on the Service from time to time, except in cases of obvious error. All prices include VAT. If a pricing error is obvious and unmistakeable and could have been reasonably recognised by you as an error, we do not have to provide the TiCL Item at the incorrect (lower) price.
Please note that acceptance of payment may be dependent on the card issuer who may require security information to be entered or validation checks to be carried out as part of their secure payment system.
Please note that all purchases of TiCL Items are strictly non-refundable. Please ensure that you have enabled any security or parental controls on your mobile device to prevent inadvertent or accidental purchases of TiCL Items. Also ensure that you log off after every session in order to prevent unauthorised access to the Service or unauthorised or accidental purchases of TiCL Items.
Information about you
Our Privacy Policy tells you how we hold and use your personal information. By using our Services you agree to us using and holding your personal information in accordance with our Privacy Policy. Please note that in order to use the Service, we require the use of your location data. More details can be found in our Privacy Policy.

We may change these Terms and Conditions and any of our policies from time to time. When we change the Terms and Conditions, our Privacy Policy or User Guidelines, registered users will be notified at log-in and will be required to indicate that you have read and accepted the revised Terms and Conditions, Privacy Policy or User Guidelines before they are able to log into their account. Unregistered users and registered users will be subject to the policies and Terms and Conditions, Privacy Policy and User Guidelines in force at the time that they use the Website or the Service.

Your Content is normally removed from the Service after 24 hours. We retain copies of the all Content (including Your Content) for such time as we consider reasonable and may, in future, make such Content (including Your Content) available on the Service or otherwise in any way we see fit.

Cookies contain information that is transferred to your computer's hard drive. They help us to improve the Service. Some of the cookies we use are essential for the Service to operate.

TiCL is about communicating with other TiCL users near you right now. It is a fun and fast way of sharing with people what’s going on around you (and them!). The best way to use TiCL is when you are trying to communicate about something that relates specifically to where you are – if it’s not specific to where you are now, perhaps you would be better communicating some other way.
We want you to have a great time on TiCL and it is important to us that the TiCL community is a friendly and responsible place. So with that in mind, here are some guidelines and helpful tips when using TiCL.
1. Everything you post on TiCL can be seen and commented upon by other registered users. Also, the most popular contributions will appear on our home page and are available to everyone, even if they are not registered. So, if you don’t want everyone to see what you have posted, please don’t post!
2. Please try and keep your posts specific to where you are. If you post something which is not specific to your location we may remove it or move it to another part of TiCL. We’re not trying to make things difficult, but TiCL works best when it shows nearby TiCL users what is going on locally where they are. We don’t want them to be disappointed!
3. We have binding TiCL Rules which are part of our Terms and Conditions. You must comply with all of these when using the Service. Please read these carefully before you post. In particular, when using TiCL, please:
a. Keep it clean. No swearing or unpleasant language
b. Keep it legal. We will not tolerate any illegal content on TiCL.
c. Keep it original. Do not copy anyone else’s work or contributions. In particular, please don’t post anyone else’s photographs unless they have permitted you to do so.
d. Keep it pleasant. We will not tolerate bullying or harassment of any type.
e. Keep it private. Remember don’t post your name or personal details or those of other people. This includes addresses, email addresses, telephone numbers, credit and debit card details, bank account numbers and anything else which you or they would not want a stranger to know.
f. Keep it tasteful. Remember that people have different views on what is tasteful and what is not.
g. Keep it authentic. Never pretend to be someone else. Also if you are a local business, we would love you to use TiCL to promote any current offers. But please keep within the law - don’t pretend to be a customer when you are not and make sure that it is obvious to other users who you are. And don’t spam – it is annoying, we don’t like it and we may stop you using TiCL if you do.
h. Keep it sensitive. Please be aware of the sensitivities of others. Particularly with photos, make sure that they are not intrusive of other people or their privacy, do not show people in distress or in embarrassing circumstances. Do not post anything gross or in dubious taste and absolutely no full frontal nudity. Make sure if your photos are of other people, that they are happy for you to post these to TiCL. In particular, please do not post photos of children unless you are their parent or guardian or, if not, unless their parent or guardian agrees that you can post the photo.
4. If you see anything that you do not like posted to TiCL please let us know by flagging it as inappropriate. We will then deal with it.
5. Above all, have fun on TiCL. By following these rules, we hope that TiCL will be a fun, friendly, useful and informative place for all its users.
